PREAMBLE
These General Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions”) exclusively govern the contractual relationship between:
SARL SALENTE, a limited liability company registered with the Montpellier Trade and Companies Register under number 987 567 179, whose registered office is located at Domaine de Salente, Gignac 34150, France (hereinafter referred to as the “Seller”),
and
Any adult consumer (over 18 years of age) making a purchase through the website https://www.masdesalente.com (hereinafter referred to as the “Customer”).
ARTICLE 1 — SCOPE AND ACCEPTANCE OF THE TERMS
These Terms and Conditions apply without restriction or reservation to all sales made through the website.
By placing an order on the website, the Customer acknowledges having read and accepted these Terms and Conditions by ticking the acceptance box prior to confirming the order.
In accordance with Article L.3342-1 of the French Public Health Code, the Customer confirms, by validating the order, that they are at least eighteen (18) years old on the date of the order.
ARTICLE 2 — PRODUCT INFORMATION
The products offered for sale are wines produced by SARL SALENTE.
Product Description
Product pages describe the grape varieties, vintages, and organoleptic characteristics of the wines. Photographs of bottles and labels are provided for illustrative purposes only and are not contractually binding. Bottle appearance, label design, or glass color may vary depending on production batches.
Availability
All offers are subject to availability. As wine is an agricultural product subject to climatic conditions and production limits, the Seller reserves the right to cancel an order in the event of stock shortages. In such cases, the Customer will receive a full refund within fourteen (14) days.
ARTICLE 3 — PRICES
All prices are displayed in Euros (€), including all applicable taxes, including VAT and excise duties applicable in France.
Shipping costs are not included in the listed price and will be calculated based on the number of bottles and delivery destination before final order confirmation.
The Seller reserves the right to modify prices at any time. However, products will be invoiced at the price applicable at the time the order is confirmed.
ARTICLE 4 — ORDERS
Orders become binding for the Customer once the order has been confirmed and payment has been completed.
Orders become final for the Seller only after confirmation has been sent to the Customer by email.
The Seller reserves the right to refuse or cancel any order for legitimate reasons, including but not limited to doubts regarding the Customer’s legal age or previous payment disputes.
ARTICLE 5 — PAYMENT
Payment is due immediately at the time of order.
Accepted Payment Methods
Payments may be made by credit or debit card via a secure payment interface.
Transaction Security
All payment transactions are secured using SSL/TLS encryption protocols to ensure the confidentiality of banking information. No credit card data is stored on the servers of the domain.
ARTICLE 6 — DELIVERY
Delivery Area
Delivery is available within mainland France. For other destinations, Customers are invited to contact the Seller.
Delivery Time
Delivery times generally range from three (3) to seven (7) business days from the date of dispatch.
Packaging
Due to the fragile nature of glass bottles, the Seller uses certified packaging designed specifically for wine bottle transportation.
ARTICLE 7 — TRANSFER OF OWNERSHIP AND RISK
Retention of Title
Ownership of the products remains with the Seller until full payment has been received.
Transfer of Risk
The risk of loss or damage to the products transfers to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the goods.
ARTICLE 8 — DELIVERY INSPECTION AND CLAIMS (BREAKAGE OR DAMAGE)
Wine shipments contain fragile items, and the Customer must inspect the parcel in the presence of the carrier upon delivery.
If damage or breakage is observed:
The Customer must refuse the parcel, or the damaged parcel if the shipment includes multiple boxes.
The Customer must note specific reservations on the delivery slip (e.g., “1 bottle broken”, “parcel opened”).
The Seller must be informed within 48 hours at: info@masdesalente.com.
If no specific reservations are recorded at the time of delivery, claims for transport-related breakage may not be accepted.
ARTICLE 9 — RIGHT OF WITHDRAWAL
In accordance with applicable consumer protection laws, the Customer has a fourteen (14) day withdrawal period from the date of receipt of the goods.
Return Conditions
Only bottles that are unopened, unsealed, and with labels intact may be returned.
Return Costs
Return shipping costs are entirely borne by the Customer. As the products remain under the Customer’s responsibility during return shipping, the Customer is advised to use secure packaging similar to the original shipment.
Refunds
Refunds will be issued within fourteen (14) days after the Seller has inspected the returned goods.
ARTICLE 10 — LEGAL WARRANTIES
The Seller is liable for:
lack of conformity, in accordance with Articles L.217-4 and following of the French Consumer Code, and
hidden defects, in accordance with Articles 1641 and following of the French Civil Code.
Customers have two (2) years from delivery to exercise their rights regarding product conformity.
Specific Nature of Wine
Wine is a natural and evolving product. The warranty does not apply to bottles that have been stored improperly (e.g., exposure to extreme temperatures, light, or humidity), or where cork taint is reported after an unreasonable storage period by the Customer.
ARTICLE 11 — LIMITATION OF LIABILITY
The Seller shall not be held liable in the following circumstances:
deterioration of wine quality caused by improper storage by the Customer after delivery,
failure to comply with local laws applicable in the country of delivery (outside France),
consequences resulting from excessive or inappropriate consumption of the product.
ARTICLE 12 — INTELLECTUAL PROPERTY
All elements of the website, including texts, visuals, logos, and images of the wines, are protected by intellectual property laws.
Any reproduction, distribution, or unauthorized use of the Mas de Salente trademarks or content is strictly prohibited and may result in legal action.
ARTICLE 13 — DATA PROTECTION (GDPR)
The personal data collected is necessary for order processing and customer management.
Customers have the right to access, correct, or request deletion of their personal data in accordance with applicable data protection regulations.

ARTICLE 14 — SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, such invalidity shall not affect the remaining provisions.
The remaining provisions shall remain fully valid and enforceable, and the parties will endeavor to replace the invalid provision with one that reflects the original intent as closely as possible.
ARTICLE 15 — FORCE MAJEURE
The performance of contractual obligations may be suspended in cases of force majeure, including but not limited to natural disasters, fires, transport strikes, or public health crises.
The Seller will inform the Customer as soon as reasonably possible.
ARTICLE 16 — MEDIATION AND DISPUTE RESOLUTION
Customer Complaints
Customers should first contact the Seller’s customer service department to attempt to resolve any dispute amicably.
Consumer Mediation
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Customers may refer the matter free of charge to an approved consumer mediator if a written complaint has not been successfully resolved.
ARTICLE 17 — APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by French law.
For disputes involving professionals, jurisdiction is exclusively granted to the Commercial Court of Montpellier.
For consumers, the applicable legal jurisdiction rules provided by consumer law shall apply.
